# Cookie Banner Terms of Use

These terms apply to the free cookie consent banner script (“the Tool”) provided by novi.digital Ltd (“Novi”, “we”). By downloading, copying, or installing the Tool on a website, you (“the User”) agree to these terms.

## 1. What the Tool Does

The Tool displays a cookie consent banner on your website and signals visitor consent choices to Google via Google’s Consent Mode v2 API (where present). It is intended as a starting point for cookie consent management, not a complete compliance solution.

## 2. Provided As-Is

The Tool is provided free of charge, “as is”, with no warranty of any kind, express or implied, including but not limited to fitness for a particular purpose or compliance with any specific law or regulation. Data protection and e-privacy laws vary by jurisdiction and change over time; the Tool reflects a UK/EU-oriented approach (UK GDPR, PECR) as understood at the time of writing and is not guaranteed to meet the requirements of every jurisdiction, industry, or website.

## 3. Your Responsibility

Installing the Tool does not, by itself, make your website compliant with data protection or e-privacy law. You remain solely responsible for:

- Having an accurate, up-to-date Privacy Policy for your own website, including disclosure of all cookies and trackers actually in use
- Confirming the Tool’s behaviour matches your actual cookie and tracking setup (for example, if you use tools beyond Google’s, you are responsible for ensuring they also respect visitor consent)
- Any legal or regulatory obligations that apply to your website, business, or jurisdiction

We recommend having the Tool, and your overall compliance approach, reviewed by a qualified professional before relying on it.

## 4. What Data the Tool Sends to Novi

Each installed copy of the Tool is linked to a unique install ID. Once per visitor session, the Tool sends a small request to novi.digital containing only the install ID and the domain the Tool is running on. No visitor personal data, cookie values, or page content is collected or transmitted by the Tool. We use this solely to confirm installs are working and, where you’ve given us your details to download the Tool, as a record of who is using it.

As with any web request, your server’s own or your hosting provider’s access logs — and ours — may incidentally record the visitor’s IP address as a normal function of how the internet works; we do not otherwise process or link this to an individual.

## 5. No Liability

To the fullest extent permitted by law, Novi accepts no liability for any loss, damage, fines, or regulatory action arising from your use of the Tool, including but not limited to reliance on it as a complete compliance solution.

## 6. Changes and Discontinuation

We may update, modify, or discontinue the Tool or this service at any time, including the install-tracking endpoint it relies on. We’ll make reasonable efforts to avoid breaking existing installs but cannot guarantee indefinite availability.

## 7. Governing Law

These terms are governed by the laws of England and Wales.
